This program has been operating in the capital since the end of 2015, when the first addresses of construction sites to be demolished were approved. In the winter of 2016, the first authorized demolition of illegally constructed buildings took place.

In the 5th wave, it is planned to demolish about 43 thousand square meters. These objects are included in this program on the basis that they are located on land plots with a special regime for their use. The Moscow City Hall in 2019 offers compensation to the owners of such buildings for voluntary dismantling. The payment amount is calculated at the rate of 55.5 thousand rubles for each sq.m. demolished premises.

If the object is demolished voluntarily with the help of state bodies assisting in dismantling, the owner has the right to receive compensation in the amount of 51 thousand rubles for each square meter.

Demolition history

Currently, the owners of samostroy, recognized by the government of the city of Moscow as necessary for demolition, voluntarily agree to dismantling.

The first involuntary demolition organized by the government of the capital took place at night in February 2016. Then, more than 700 pieces of equipment drove onto the streets of the golden-domed, and more than 100 objects were demolished.

That night, many cafes and trade pavilions familiar to the residents of the capital were dismantled. This event was remembered by many residents. Basically, superstructures and pavilions near the entrances to metro stations were dismantled.

After an almost voluntary dismantling at the end of 2016, a new fourth wave list was published. It contained 54 buildings mainly located in:

The largest object, with an area of ​​more than 3,500 square meters, then turned out to be a shopping center on Kronstadt Boulevard. Then its owners agreed to the dismantling with the participation of the city prefecture and received compensation.

About 75% of the fourth wave was demolished voluntarily, and the rest of the buildings were destroyed in the winter of 2017. And at the end of the summer of 2017, the fifth wave was published, which included fairly well-known construction projects.

In the North-Western region, the main blow to the cleanup will be on Stratonavtov 8A passage, where buildings 1 to 8 will be demolished. In addition, the fifth wave will affect buildings at the following addresses:

  2. st. Nelidovskaya 13, building 1.
  3. Rainis boulevard 2.

Demolition of the following buildings in the North-Eastern District is planned:

At the end of June, the Moscow authorities published a new list of unauthorized construction for demolition, which included 107 buildings with a total area of ​​31,000 sq.m. The "second wave" of the demolition of the squatter took place at the end of August, with most of the owners agreeing to dismantle illegal objects on their own. At the beginning of October, 43 objects with a total area of ​​26.7 thousand square meters were included in the "third wave".

In February 2017, the fourth stage of the demolition of the squatter building was completed, which included 54 objects. The "fifth wave" of dismantling in August last year included 78 facilities with a total area of ​​42.3 thousand square meters.

Starting with the "second wave", volunteers who have decided to dismantle the facility on their own or have declared their consent to dismantling with the assistance of the city are eligible for compensation. Payments for demolition by the owner amount to 55.5 thousand rubles per square meter of real estate. If the owner turned to the city for assistance, compensation will amount to 51 thousand rubles per sq.m. The period allotted for voluntary dismantling is calculated taking into account the height of the unauthorized building and the area of ​​the occupied site.

In general, in less than four years, almost 4 thousand unauthorized buildings with a total area of ​​​​about 1.3 million square meters were demolished in the capital. According to Sergei Shogurov, the head of the state inspection for monitoring the use of real estate in Moscow, the authorities are not planning to arrange new waves of demolition.

In October last year, he also noted that as part of the planned work with the owners of squatters in the capital, there are 200-300 trials.

In August 2018, Russian President Vladimir Putin signed a law regulating the rules for the demolition of unauthorized construction sites and protecting the rights of bona fide building owners. A person who has carried out an unauthorized construction shall not acquire the right of ownership to it, and the construction itself shall be subject to demolition.

Until September 01, 2015, the forced demolition of an unauthorized building could be carried out only on the basis of a court decision.

Federal Law No. 258-FZ of July 13, 2015 amended Article 222 of the Civil Code of the Russian Federation and the Federal Law “On Enactment of Part One of the Civil Code of the Russian Federation”. The changes that came into effect on September 01, 2015 give the authorities local government city ​​district with the authority to make a decision on the demolition of an unauthorized building out of court.
